Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Hylo (“Hylo,” “we,” “us”), an AI-powered platform for jewelry product photography, video, and creative asset generation available at tryhylo.com. By creating an account, purchasing credits, or otherwise using Hylo, you agree to these Terms. If you don't agree, please don't use Hylo.

1. Who can use Hylo

You must be at least 16 years old to use Hylo. If you're creating an account on behalf of a business, you confirm you have authority to bind that business to these Terms. One person or business per account; you're responsible for activity under your account, including keeping your credentials secure.

2. The service

Hylo lets you upload jewelry product images and use AI to generate studio photography, retouched images, recreated compositions, and short product videos. AI output quality varies; we don't guarantee any specific look, accuracy, or commercial usability.

We may add, change, or remove features at any time. If a change materially reduces what you paid for, we'll honor the credits you have or offer a comparable substitute.

3. Credits and payment

Hylo runs on credits. You receive 15 free credits on signup and can purchase additional plans (Base, Core, or Pro). Each plan is a one-time purchase— we don't charge recurring fees or auto-renew. Credits never expire.

Payments are processed by third-party payment providers depending on your region. By purchasing, you authorize the relevant processor to charge your payment method. Pricing on /pricing is the source of truth; we may change pricing for future purchases but won't alter the value of credits you already own.

Refunds are governed by our Refund Policy.

4. Your content and our content

Your inputs. You retain all rights to the product images, brand assets, and other content you upload to Hylo (“Inputs”). You grant Hylo a worldwide, non-exclusive, royalty-free license to host, process, and transmit your Inputs solely to provide the service to you (for example, sending an image to the AI model that generates your output).

Your outputs. You own the AI-generated images, videos, and other outputs you create on Hylo (“Outputs”) to the maximum extent permitted by applicable law. You are free to use Outputs for personal or commercial purposes, including selling jewelry on your storefronts, marketplaces, advertising, and printed materials.

Important caveats about AI output ownership. AI outputs may resemble other outputs generated from similar inputs. We don't guarantee Outputs are unique, original, or free from third-party rights. You're responsible for ensuring your use of Outputs doesn't infringe the rights of others (for example, don't use Hylo to recreate a copyrighted designer's exact piece).

Hylo's content. The Hylo product, brand, prompts, model configurations, UI, and code remain our intellectual property. Nothing in these Terms grants you a license to copy, redistribute, or reverse- engineer Hylo itself.

5. Acceptable use

You agree to use Hylo lawfully and within the limits described in our Acceptable Use Policy. In particular, you must not use Hylo to generate content that infringes intellectual property, impersonates people or brands, creates misleading or harmful imagery, or violates any law in your jurisdiction. We may suspend or terminate accounts that violate this policy.

6. Service availability

We work hard to keep Hylo running smoothly, but we don't guarantee uninterrupted service. Generation can fail due to model issues, infrastructure problems, or content-safety filters. When a generation fails on our end, the credits you spent on it are automatically refunded to your balance.

We may perform maintenance, deploy updates, or temporarily restrict access for security or operational reasons without prior notice.

7. Privacy

Our Privacy Policy explains what we collect, why, who has access, and how to exercise your rights. By using Hylo, you also agree to the Privacy Policy.

8. Account suspension and termination

You can close your account at any time from /settings/account or by emailing us. Unused credits remain in your account until you delete it; once deleted, credits are forfeit and not refundable in cash (refund requests reviewed per our Refund Policy).

We may suspend or terminate your account if you violate these Terms, the Acceptable Use Policy, or applicable law, or if your account is used in a way that creates legal, security, or financial risk for Hylo or other users. Where reasonable, we'll try to give you notice and a chance to correct the issue first.

9. Disclaimers

Hylo is provided “as is” and “as available.” To the extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that generation will always succeed, that Outputs will meet your expectations, or that the service will be uninterrupted or error-free.

10. Limitation of liability

To the maximum extent permitted by applicable law, Hylo and its owners, employees, and contractors will not be liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits, lost data, or business interruption, arising from your use of (or inability to use) Hylo. Our total liability for any claim arising out of these Terms is limited to the greater of (a) the amount you paid Hylo in the 12 months before the claim, or (b) ₹5,000 / USD 60.

11. Indemnity

You agree to defend, indemnify, and hold Hylo harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising from (a) your use of Hylo in violation of these Terms or the Acceptable Use Policy, (b) content you upload or generate that infringes the rights of others, or (c) your violation of any law in connection with Hylo.

12. Changes to these Terms

We may update these Terms occasionally. When we do, we'll update the “Last updated” date above and, for material changes, post a notice in-app or email you. Continued use of Hylo after a change means you accept the updated Terms. If you don't agree, you can stop using Hylo and request a refund per the Refund Policy.

13. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Any dispute that can't be resolved by email first will be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India. Nothing in these Terms prevents either party from seeking urgent injunctive relief in any competent court.
